Shipping costs and payment fees are recognized before confirming the purchase.

This page contains the terms & conditions. Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.
By placing an order at CUCULA, you warrant that you are at least 18 years old (or have parents’ permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at CUCULA for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.
The following General Terms and Conditions of Business (TCB) of CUCULA e. V. apply to all orders by consumers on the online shop. Consumer means any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly to their commercial or self-employed occupational activity.

Conclusion of contract
The display of products in the online shop is not a legally binding offer, but only an invitation to place a legally binding order. By clicking the order button you are making a binding order for the products in the basket. Confirmation of receipt of the order will follow with simultaneous acceptance of the order by automated email immediately after submission of the order. With this email confirmation the purchase contract becomes legally effective.
The ordered products may differ slightly from the display due to the technical limitations of the display, especially in colour, in so far as this is reasonable.
All products remain the property of CUCULA until full payment is made. The purchase price quoted is binding. The purchase price includes the statutory value added tax. Costs of packaging are already included in the shipping costs. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents’ permission to buy from CUCULA. Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.
The customer shall pay the purchase price and any delivery costs at the latest within 14 days after receiving the order or within 30 days after receiving the receipt of the electronic order confirmation. On expiry of this period the customer shall be in default of payment.
All transfers conducted through CUCULA are handled and transacted through third party dedicated gateways to guarantee your protection.Please read the terms & conditions for the payment gateway choosen for the transaction as they are responsible for the transactions made.
The payment can effected by PayPal. The terms and conditions of use of the provider shall apply.
(1) The customer can effect payment by payment in credit card, PayPal or on account.
(2) In the case of payment by PayPal the customer must register at www.paypal.com.
(3) In the case of purchase on account the customer is informed during the ordering process of the applicable special terms and conditions of business and must then expressly agree to these.
The period for delivery is given on the respective web page. CUCULA may make part deliveries where there are legitimate grounds on the part of CUCULA and part delivery is reasonable for the customer. Additional costs are incurred by CUCULA as a consequence.
Depending on delivery method you may be required to pick up the order at a specific delivery point. You are required to do so within the time specified in the notification of delivery. If you do not pick up the delivery in time you may be charged a fee and the order may be sent back to us at your expense. We may also cancel the order if the delivery is not picked up in time.
Transfer of risk
The risk of accidental loss or accidental deterioration of the goods sold shall pass to the customer on handover of the goods.If the customer fails to take delivery, this shall be deemed equivalent to hand-over.
Data, drawings, illustrations, technical data, descriptions of weight, dimensions and performance, held outside our web shop, are purely informatory. CUCULA gives no warranty for the accuracy of these details. With respect to any supply of goods only the information contained in our confirmation of order shall be relevant.
In case of a defect covered by warranty, the customer may in accordance with statutory provisions require supplementary performance, withdraw from the contract or reduce the purchase price.
In the case of returns due to defects CUCULA shall bear the costs of returning the goods.
CUCULA is therefore not liable for continuous and uninterrupted availability of the online offering.
Statutory provisions govern the limitation period for warranty claims in respect of the goods supplied.
CUCULA reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, CUCULA has the right to cancel the order and refund any amount paid in the best way. CUCULA shall also notify the customer of equivalent replacement products if available.
Intellectual Property Rights
The Website and all its content is owned by CUCULA or our licensors and protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without our prior written consent.
The law of the Federal Republic of Germany applies excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). This applies only in so far as it does not deprive the Purchaser of the protection guaranteed by mandatory provisions of the legislation of the country in which the Purchaser is ordinarily resident.
